AMENDING THE CODE
OF THE TOWN OF BABYLON, CHAPTER 89 (BUILDING CONSTRUCTION)
BY ADDING
SECTION 89-13.2 (CONSTRUCTION SITE SAFETY TRAINING)

WHEREAS, recent studies have indicated that 340
workers die each day in
America from hazardous
working conditions and
4,764 workers were killed on
the job in 2020 (see “Death
on the Job, The Toll of Neglect” AFL-CIO Safety and
Health Office Report, April
2022); and
WHEREAS, the construction industry has one of
the highest fatality rates in
America with 10.2 deaths
per 100,000 workers, id; and
WHEREAS in New York
State, the construction industry fatality rate is higher
than the national average
with construction deaths
accounting for twenty four
percent of worker deaths in
New York State as reported
by the New York Committee
for Occupational Safety and
Health in its 2022 Deadly
Skylines report (https://
nycosh.org/nycosh_ deadlyskyline report_ 2022/); and
WHEREAS, in light of
the foregoing, it is the purpose and intent of the Town
Board to adopt a Local Law
No. 19 of 2022 amending
the Babylon Town Code,
Chapter 89 (Building Construction) by adding Section
89-13.2 (Construction Site
Safety Training) to promote
the safety of construction
sites within the Town of
Babylon by ensuring that
workers employed or otherwise engaged at such construction sites have received
adequate safety training,
and that contractors performing construction work
have essential safety training
systems to prevent injuries
and protect workers who are
injured; and
WHEREAS, the Town

Board of the Town of Babylon duly called and held a
Public Hearing at Babylon
Town Hall, 200 East Sunrise Highway, Lindenhurst
NY 11757 on the 12th day
of October, 2022 upon the
question of enactment of
Local Law No. 19 of 2022 of
the Town of Babylon, Suffolk
County, New York, being a
Local Law adding Section

GENERAL AND ADMINISTRATIVE PROVISIONS ***
§ 89-13.2 Construction
Site Safety Training
A. Purpose. The provisions of this section are
intended to promote the
safety of minor and major
construction sites within
the Town of Babylon. The
provisions of this section
are designed to provide
that workers employed or
otherwise engaged at such
construction sites have
received adequate safety
training; that contractors
performing construction
work have essential safety
training and that contractors
performing construction
work have essential safety
training systems to prevent
injuries and protect workers
who are injured.
B. Definitions. As
used in this section, the following terms shall have the
meanings indicated:
CONTRACTOR

Any person contracted or
subcontracted to perform
work covered by this section
for or on behalf of any other
person.
MAJOR CONSTRUCTION PROJECT
A construction site, with
an area greater than 50,000
square feet, which involves
the construction, demolition
or alteration of a structure or
building.
MINOR CONSTRUCTION PROJECT
A construction site, with
an area greater than 35,000
square feet and less than
or equal to 50,000 square
feet, which involves the
construction, demolition or
alteration of a structure or
building.
OSHA
The United States Department of Labor Occupational
Safety and Health Administration. OSHA 30-HOUR CLASS
A class that includes 30 or
more hours in construction
industry safety and health
that is intended for workers
and satisfies the following
conditions:
1) Such class is: i)
approved by OSHA and
conducted in accordance
with the OSHA outreach
training program, or ii) an
equivalent 30- or more hour
construction industry safety
and health class approved by
the Building Inspector.
2) Such class consists of in-person training,
actively proctored online
training or, if such training
is conducted before the effective date of this section,
online training.
OSHA 100-HOUR CLASS
A class or program that:
1) includes 100 or
more hours of training in
technical subjects relating
to a construction trade,
including an apprenticeship
program registered with the
New York State Department
of Labor; and
2) is approved by
OSHA, the United States
Department of Labor, the
New York State Department
of Education or the New
York State Department of
Labor and consists of inperson training, actively
proctored online training or,
if such training is conducted
before the effective date of
this section, online training.
PERMIT HOLDER
The person to whom a
building permit has been
issued or for whom a building permit has been applied.
PERSON

An individual, corporation, limited liability company, partnership, limited
partnership, business trust,
estate, trust, association,
or any other legal or commercial entity of any kind
or description.
SITE SAFETY DESIGNEE The site safety designee
must have completed an
OSHA 100-hour class. On a
major construction project,
the site safety designee shall
use reasonable prudence to
ensure that safety is maintained as job conditions
dictate and shall complete
any tasks required of a site
safety designee set forth in
this section.
C.Safety training required.
1.In addition to any other
applicable provisions of this
Code, or any federal, state
or county law or rule, each
permit holder:
a.At a minor construction
site, shall be responsible for
ensuring that each construction or demolition worker
employed or otherwise engaged at such site by the
permit holder or any person
performing work for or on
behalf of such permit holder
at such site has successfully
completed and maintains a
current OSHA 30-hour class
certificate.
b.At a major construction
site, shall be responsible for
ensuring that a foreman
or designated employee or
individual otherwise engaged at such site by the
permit holder or any person
performing work for or on
behalf of such permit holder
is designated as a site safety
designee. The site safety
designee shall be tasked with
ensuring that each construction or demolition worker
employed or otherwise engaged at such site by the
permit holder or any person
performing work for or on
behalf of such permit holder
at the site is in compliance
with § 89-13.2(C)(1)(a) and
shall report violations of this
requirement to the Building
Inspector.
2.The applicant, permit
holder or any person performing such work on behalf of the permit holder
shall certify to the Building
Inspector, in a form and
manner established by the
Building Inspector, that
the requirements of § 89-
13.2(C)(1)(a) and/or (b)
have been met. No permit
for construction or demolition work for which training
is required pursuant to this

section shall be issued or
renewed until the applicant
has certified that all workers
who will be working under
such permit will have the
requisite training throughout the duration of such
permit.
3.The applicant, permit
holder or any person performing such work on behalf of the permit holder
shall certify that all New
York State and OSHA safety
requirements and workers’
compensation and insurance requirements have
been met.
4. The permit holder
shall maintain at such site a
daily log that identifies each
such worker and that includes, for each such worker,
proof of compliance with §
89-13.2(C)(1)(a) and (b), as
applicable. Such logs shall
be made available to the
Building Inspector upon request and shall be submitted
to the Building Inspector as
a prerequisite to the issuance
of a certificate of occupancy
and/or certificate of completion. D.Penalties.
1.Any violation of this
section by a permit holder
shall be an offense punishable by a fine of not less
than $1,000 nor more than
$10,000. Each worker performing work on a construction site covered by this section without required safety
training shall constitute a
separate additional offense.
Each day that any violation
continues shall likewise constitute a separate additional
offense.
2.For a second or subsequent offense committed
by a permit holder within a
period of five years, such offense shall be punishable by
a fine of not less than $3,000
nor more than $20,000 or by
imprisonment for a period
not to exceed 15 days, or
both.
3.In addition, any permit
issued to a permit holder
who has violated this section may be revoked by the
Building Inspector after
giving the permit holder
written notice and an opportunity to be heard.
4.The Building Inspector shall be authorized to
issue stop-work orders for
violations of this section
pursuant to § 89-12. Upon
the issuance of a stop-work
order, the owner of the affected property, the permit
holder and any other person
or contractor performing,
taking part in or assisting

in the work shall suspend
all construction activities
until the stop-work order
has been rescinded.
Section 2.Severability
If any clause, sentence,
paragraph, subdivision, section or other part of this local law shall for any reason
be adjudge by any court of
competent jurisdiction to be
unconstitutional or otherwise invalid, such judgment
shall not affect, impair or
invalidate the remainder of
this local law, and it shall be
construed to have been the
legislative intent to enact
this local law without such
unconstitutional or invalid
parts therein.
Section 3.Effective Date
This local law shall take effect immediately upon filing
in the Office of the Secretary
of the State of New York.

CERTAIN PROPERTIES
AFFECTED BY SUPERSTORM SANDY
§ 195-43. Exemption
An owner occupied residential property that is the
primary residence of the
owner reconstructed, altered, or improved due to
damage caused by Superstorm Sandy, as defined by
Subdivision 5 of Section 2 of
Chapter 424 of the New York
State Laws of 2013, within
an eligible municipality, as
defined by Subdivision 2 of
Section 2 of Chapter 424 of
the Laws of 2013 the Town
of Babylon shall be exempt
from taxation of county,
Town and school levies by
the Town to the extent provided hereinafter. After a
public hearing, the governing board of an eligible municipality may adopt a local
law and a school district may
adopt a resolution to grant
the exemption authorized
pursuant to this act. A copy
of such local law or resolution shall be filed with the
commissioner of taxation
and finance and the assessor
of such municipality who
prepares the assessment
roll on which the taxes of
such municipality or school
district are levied.
§ 195-44. Eligiblity
To be eligible for the tax
exemption authorized by
an eligible municipality or
school district pursuant
to § 195-43, such primary
residence shall have been
owner-occupied by the same
owner immediately prior to

Superstorm Sandy and immediately after reconstruction with a certificate of
occupancy, and have already
received assessment relief
pursuant to Chapter 424 of
the New York State Laws of
2013.
§ 195-45. Extent of exemption Such primary residence
shall be exempt for a period
of one year to the extent of
100% of the increase in assessed value thereof attributable to such reconstruction,
alteration or improvement
and for an additional period
of seven years subject to the
following:
A. The extent of
such exemption shall be
decreased by 12.5% of the
“exemption base” each year
during such additional period. The “exemption base”
shall be the increase in assessed value as determined
in the initial year of the term
of the exemption, except as
provided in Subsection B.
B. In any year in
which a change in level of
assessment of 15% or more
is certified for a final assessment roll pursuant to the
rules of the commissioner
of taxation and finance of
the State of New York, the
exemption base shall be
multiplied by a fraction,
the numerator of which
shall be the total assessed
value of the parcel on such
final assessment roll (after
accounting for any physical
or quantity changes to the
parcel since the immediately preceding assessment
roll), and the denominator of which shall be the
total assessed value of the
parcel on the immediately
preceding final assessment
roll. The result shall be the
new exemption base. The
exemption shall thereupon
be recomputed to take into
account the new exemption base, notwithstanding
the fact that the assessor
of such municipality Babylon Town Assessor receives
certification of the change
in level of assessment after
the completion, verification
and filing of the final assessment roll. In the event the
assessor of such municipality does not have custody
of the final assessment roll
when such certification is
received, the assessor of such
municipality shall certify
the recomputed exemption
to the local officers having
custody and control of the
final assessment roll, and
such local officers are hereby
directed and authorized

to enter the recomputed
exemption certified by the
assessor of such municipality on the final assessment
roll. The assessor of such
municipality Babylon Town
Assessor shall give written
notice of such recomputed
exemption to the property
owner, who may, if he or she
believes that the exemption
was recomputed incorrectly,
apply for a correction in the
manner provided by Title 3
of Article 5 of the New York
State Real Property Tax Law
for the correction of clerical
errors.
C. Such exemption
shall be applied to the difference in the pre-storm
assessed value and the
increased assessed value
attributable to all the reconstruction, alterations
or improvements due to
Superstorm Sandy. For the
purposes of this section,
the market value of the reconstruction, alteration or
improvement shall be equal
to the increased assessed
value attributable to such
reconstruction, alteration
or improvement divided by
the Class I ratio in a special
assessing unit or the most
recently established state
equalization rate or special
equalization rate in the remainder of the state, except
where the state equalization
rate or special equalization
rate equals or exceeds 95%,
in which case the increase
in assessed value attributable to such reconstruction,
alteration or improvement
shall be deemed to equal
the market value of such
reconstruction, alteration or
improvement.
§ 195-46. Date of commencement. [Amended 12-5-2018 by
L.L. No. 21-2018]
No such exemption shall
be granted for reconstruction, alterations or improvements unless commenced
due to damage caused by
Superstorm Sandy, and reflected on a certificate of occupancy no later than March
1, 2020 2024. The enactment
of a local law or resolution
granting the exemption authorized pursuant to this act
may limit eligibility for the
exemption to those forms
of reconstruction, alterations or improvements as
are prescribed in such local
law or resolution; provided,
however, that in no case
shall No such exemption be
granted for reconstruction,
alterations or improvements
to aspects of a primary residence not in existence or

otherwise not a part of the
primary residence prior to
October 29, 2012.
§ 195-47. Application.

L.L. No. 21-2018]
Application for such exemption shall be filed with
the assessor of an eligible
municipality the Babylon
Town Assessor by the first
of March after the adoption
of a local law or resolution
pursuant to subdivision a
of this section the date on
which this article shall have
become a law, or the first of
March of any subsequent
year thereafter but no later
than March 1, 2020 2024,
on a form prescribed by the
commissioner of taxation
and finance of the State of
New York.
§ 195-48. Granting of
exemption.
If satisfied that the applicant is entitled to an exemption pursuant to this
act article, the assessor of
such municipality Babylon
Town Assessor shall approve
the application and such
primary residence shall be
exempt from taxation for
up to eight prospective tax
years as provided by this act
article. The assessed value of
any exemption granted pursuant to this act article shall
be entered by the assessor
of such municipality on the
assessment roll with the taxable property Babylon Town
Assessor with the amount of
the exemption shown in a
separate column.
§ 195-49. Primary residence.

For the purposes of this
article, a “primary residence” shall mean any building or structure designed
and occupied exclusively for
residential purposes by not
more than three families,
and occupied by the owner
as a primary residence.
§ 195-50. Cessation of
exemption.
In the event that a primary residence granted an
exemption pursuant to this
article ceases to be used as
a primary residence of the
owner, or the title thereto is
transferred, the exemption
granted pursuant to this article shall cease. However, the
exemption granted pursuant
to this article shall continue
for the remaining exemption
period for as long as an heirat law or distributee of such
owner occupies the property
as a primary residence.
§ 195-51. Limitations.

No such local law or resolution shall reduce or repeal
an exemption granted pursuant to this article until the
expiration of the period for
which such exemption was
granted.
§ 195-52. When Effective.

CHAPTER 213 (ZONING), ARTICLE XIV (G
INDUSTRIAL USES)
Section 1. ADD as
follows:
CHAPTER 213 – ZONING ARTICLE XIV G INDUSTRIAL DISTRICT

§ 213-166 Permitted Uses
***
J. Stone cutting operations. (1) Definition. Stone
cutting shall be defined as
the cutting of any natural
stone or composite material
including but not limited to
marble, granite, siltstone or
plastics.
(2) The use of G Zone
property for stone cutting
shall be permitted when
authorized by special use
permit issued by the Zoning
Board of Appeals subject
to the following conditions
and any additional conditions imposed by the Zoning
Board of Appeals:
a. All wastewater
from the stone cutting machinery shall be adequately
captured, contained and
recycled, as set forth in an
engineering plan.
b. All wastewater
in the work area shall be
captured within suitable
trenches so as not to create
standing water in the work
area, as set forth in an interior drainage plan.
c. There shall be no
discharge of wastewater
into the exterior stormwater
drainage system.
d. There shall be an
engineered air filtration/
duct system to capture all
dust emissions from the
stone cutting machinery. No
dust shall be discharged outside the building or structure in which the stone cutting operation is located.
e. The stone cutting
operation shall comply with
all applicable federal, state
and local regulations including those of the Occupational

Safety and Health
Administration, the New
York State Department of
Environmental Conservation, and the Suffolk County
Department of Health Service. (3) Applicability. The
criteria set forth in this section shall apply to any new
development and to the addition of a new stone cutting
operation to any existing
development.

NOTICE IS HEREBY
GIVEN that the Town Board
of the Town of Babylon,
County of Suffolk, State of
New York, at a regular meeting thereof held on the 16th
day of November, 2022 duly
adopted a resolution, an abstract of which is as follows:
NOVEMBER 16, 2022
ADOPTING LOCAL
LAW NO. 21 OF 2022 –
TAX CAP OVERRIDE
WHEREAS, the
Town Board of the Town of
Babylon having duly called
and held a Public Hearing
at Babylon Town Hall, 200
East Sunrise Highway, Lindenhurst, New York, on the
10th day of November 2022,
to consider the adoption of a
local law authorizing a property tax levy in excess of the
limit established in General
Municipal Law Section 3-c;
and
WHEREAS, all
persons were given an opportunity to speak for or
against this local law.
NOW, THEREFORE, BE
IT
RESOLVED AND ORDAINED, by the Town
Board of the Town of Babylon that Local Law No. 21
of 2022, Tax Cap Override
as set forth in the annexed
Exhibit “A” of the Town of
Babylon, Suffolk County,
New York, is hereby enacted
as follows and effective upon
its filing with the New York
State Department of State.
EXHIBIT “A”
TAX CAP OVERRIDE
Section 1. Legislative Intent It is the intent of this local law to allow the Town of
Babylon to adopt a budget
for the fiscal year commencing January 1, 2023 that

requires a real property tax
levy in excess of the “tax levy
limit” as defined by General
Municipal Law Section 3-c.
Section 2. Authority
This local law is adopted
pursuant to subdivision 5
of General municipal Law
Section 3-c which expressly
authorizes a local government’s governing body to
override the property tax
cap for the coming fiscal
year by the adoption of a
local law approved by a vote
of sixty percent (60%) of said
governing body.
Section 3: Tax Levy Limit
Override
The Town Board of the
Town of Babylon, County
of Suffolk, is hereby authorized to adopt a budget for
the fiscal year commencing
January 1, 2023 that requires
a real property tax levy in
excess of the amount otherwise prescribed in General
Municipal Law Section 3-c.
Section 4: Severability
If a court determines
that any clause, sentence,
paragraph, subdivision, or
part of this local law or the
application thereof to any
person, firm or corporation,
or circumstance is invalid or
unconstitutional, the court’s
order or judgment shall not
affect, impair, or invalidate
the remainder of this local
law, but shall be confined in
its operation to the clause,
sentence, paragraph, subdivision, or part of this local
law or in its application to
the person, individual, firm
or corporation or circumstance, directly involved in
the controversy in which
such judgment or order shall
be rendered.
Section 5: Effective date
This local law shall take effect immediately upon filing
with the Secretary of State.
