Final Notice and Public Explanation of a Proposed Activity in a 100 Year Floodplain
This is to give notice that the Town of Babylon has conducted an evaluation as required by Executive Order 11988 and
11990 in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations of Floodplain Management to determine the potential affect that its activity in the floodplain and wetland will have on the human
environment for the Long Island Housing Partnership (LIHP) Sandy Rebuild Long Island project. The proposed Sandy
Rebuild Long Island project entails LIHP reconstruction of six homes to be built on properties provided to LIHP by NY
Rising. The six properties were impacted by flooding from Superstorm Sandy, are located in the floodplain and are within
300 feet of tidal wetlands. LIHP Plans to demolish the existing homes that are too severely damaged to be rehabilitated
and build new homes that meet local flood code requirements. Purchasers must be first time homebuyers with incomes
that do not exceed 80% of the HUD established median income for Long Island. LIHP is requesting HOME funds (Grant
# M-16-MC36.200 and M-17-MC-0200) to provide Down Payment Assistance (DPA) to eligible first time homebuyers.

The Town of Babylon has considered a no action alternative and mitigation measures to minimize adverse impacts. The
no action alternative would not address the need for safe and affordable housing nor would it assist in providing flood
protection by elevating or rebuilding damaged homes in the floodplain. Further, GOSR determined during the acquisition
process of these parcels that a policy to prohibit redevelopment in the floodplain is not considered practicable due to the
great number of homes residing in the flood zone. Funding the LIHP Sandy Rebuild Long Island project would require
all proposed construction to adhere to the latest flood code standards. Construction to flood code will mitigate flooding
impacts to future residents of these homes while also reducing impacts to the community hosting those homes. All homes
participating in the program shall also comply with NYSDEC tidal wetland regulations whereby a tidal wetlands permit
will be obtained for all properties within jurisdiction of New York Tidal wetland regulations. Adhering to these permits
will minimize adverse impacts to nearby wetlands.
Based on the above reasoning, no practicable alternative to the LIHP Sandy Rebuild Long Island project has been identified. This finding concurs with the environmental review performed for GOSR prior to their acquisition. Environmental
files that document compliance with steps 3 through 6 for Executive Orders 11988 and 11990 are available at the location
below. This activity will have no significant impact of the environment for the following reasons:
1) Construction will be limited to sites that were previously developed with single family homes and the action will replace
these homes that have been substantially damaged. Construction to flood code will mitigate future impacts of flooding
to future occupants and to the communities hosting these homes by reducing the need for community services during
future flooding events.
2) Project sites within jurisdiction of NYSDEC Tidal Wetlands regulation will apply for and obtain a tidal wetlands permit
prior to construction. Adhering to the terms and conditions of the wetland permit will address and mitigate potential
impacts to the nearby wetlands.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those
who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public
educational tool. The dissemination of information about floodplains can facilitate and enhance Federal efforts to reduce
the risks associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the
Federal government determines it will participate in actions taking place in floodplains, it must inform those who may
be put at greater or continued risk.

Free and reduced school meal policy

The following school districts are offering free and reduced price
meals for students meeting eligibility guidelines, as set down by the
Federal government. Households which currently include children
who receive food stamps or Aid to Dependent Children or Food
Distribution Program, Indian Reservations, must complete an application listing the child’s name, a food stamp or other number and
signature of an adult household member to participate. Households
with annual incomes of no more than $15,782, one person, to
$55,094 for 8 people, (for each additional member, add $5,616) are
eligible for free lunch-breakfast-milk.
In addition, households with annual incomes of no more than
$22,459, one person, to $78,403 for 8 people, (for each additional
member, add $7,992) are eligible for reduced price lunch-breakfast. No child may be discriminated against because of race, gender
or sexual orientation, color, national origin, age or handicap. If any
member of a household believes that they have been discriminated
against, they should write to the USDA, Director, Office of Civil
Rights, Room 326-W, Whitten Building, 1400 Independence Ave.,
