Pursuant to provisions of
Local Law # 9 of the Babylon
Town Code, notice is hereby
given that the Town of Babylon Accessory Apartment
Review Board will hold a
public hearing in the Town
Hall, 200 East Sunrise Highway, Lindenhurst, New York
on Tuesday evening, January

ADOPTING LOCAL LAW
NO. 3 AMENDING
CHAPTER 213 ARTICLE
VII, OF THE CODE OF
THE TOWN OF BABYLON
(ZONING)

WHEREAS, the Town
Board of the Town of Babylon having duly called and
held a Public Hearing at
Babylon Town Hall, 200 East
Sunrise Highway, Lindenhurst, New York, on the 14th
day of January 2013 upon
the question of enactment
of Local Law No.3 of 2013,
of the Town of Babylon,
Suffolk County, New York,
being a Local Law amending the Code of the Town
of Babylon, Chapter 213,
Article VII;

NOW, THEREFORE, be it
RESOLVED AND ORDAINED, by the Town Board
of the Town of Babylon that
Local Law No.3 of 2013, of
the Town of Babylon, Suffolk
County, New York, is hereby
enacted as follows and effective upon its filing with the
New York State Department

Zoning Amend
§213-63 Building height.
In an A Residence District,
no building or structure
hereafter erected or altered
shall exceed 30 feet or 2
1/2 stories. The maximum
height allowance of 30 feet
for existing habitable buildings or structures hereafter altered to increase the
height of said building or
structure located within
the Base Flood or Hundred
Year Flood Zone may be increased in order to meet the
enhanced height requirements in accordance with
Chapter 125 of this Code
and FEMA regulations. Said
height allowance shall not
exceed the enhanced height
requirements above grade
as defined in Chapter 125 of
this Code.
