NOTICE OF ADOPTION OF RESOLUTION
NOTICE IS HEREBY GIVEN that the Town Board of the Town of Babylon, County of Suffolk, State of New York, at a regular
meeting thereof held on the 23d day of October 2012 duly adopted a resolution, an abstract of which is as follows:
RESOLUTION NO. 739 OCTOBER 23, 2012
ADOPTING AMENDMENTS TO
CHAPTER 2, ARTICLE IV, SECTION 2-8 OF THE TOWN OF BABYLON
UNIFORM CODE OF TRAFFIC ORDINANCES
WHEREAS, the Town Board of the Town of Babylon having duly called and held a Public Hearing at Babylon Town
Hall, 200 East Sunrise Highway, Lindenhurst, New York, on the 23d day of October 2012 upon the question of adopting,
Article IV, Section 2-8 of the Town of Babylon Uniform Code of Traffic Ordinances
NOW, THEREFORE, be it
RESOLVED AND ORDAINED that the amendments to the Uniform Code of Traffic Ordinances, as set forth herein as
Exhibit “A”, be and the same are hereby adopted effective immediately; and be it further
RESOLVED AND ORDAINED that the Director of Traffic Safety be authorized and directed to install, erect, remove
or replace such signs or other traffic safety devices as may be required by these amendments or by the New York State
Vehicle and Traffic Law.

LAW NO. 14 AMENDING
CHAPTER 213 ARTICLE
XXVI, OF THE CODE OF
THE TOWN OF BABYLON (On-Premises Food
and Beverage Consumption
Establishments)
WHEREAS, the Town Board
of the Town of Babylon having duly called and held a
Public Hearing at Babylon
Town Hall, 200 East Sunrise Highway, Lindenhurst,
New York, on the 23d day
of October 2012 upon the
question of enactment of
Local Law No. 14 of 2012,
of the Town of Babylon,
Suffolk County, New York,
being a Local Law amending the Code of the Town
of Babylon, Chapter 213,
Article XXVI;
NOW, THEREFORE, be it
RESOLVED AND ORDAINED, by the Town
Board of the Town of Babylon that Local Law No.14 of
2012, of the Town of Babylon, Suffolk County, New
York, is hereby enacted as
follows and effective upon
its filing with the New York
State Department of State:

Chapter 213 ARTICLE XXVI
On-Premises Food and
Beverage Consumption
Establishments
Amending §213-347.
Permits required.
A.All new bars, taverns,
restaurants, cafes and other
places for the serving of food
or beverages, or both food
and beverages, whether such
food and/or beverages are
served inside a structure or
outside a structure, or both
inside and outside a structure, shall be permitted only
by special exception permit
from the Planning Board after the required public hearing except when located in
a Planned Shopping center
over 350,000sf.

B. Any new bars, taverns,
restaurants, cafes and other
places for the serving of food
or beverages, or both food
and beverages, whether such
food and/or beverages are
served inside a structure or
outside a structure, or both
inside and outside a structure, shall be excluded from
the requirement of a special
exception permit from the
Planning Board if those
establishments have seating
for 16 or fewer persons and
such establishments shall
be primarily in the business of preparing food and
beverages for off-premises
consumption. "Seating" or
"a seat" shall be defined as
a physical chair and/or a
stool capable of seating one
person and/or 1 1/2 feet of
counter space or space in
a booth or bench seating
except when located in a
Planned Shopping center
over 350,000sf.
C.All existing bars, taverns,
restaurants, cafes and other
places for the serving of
food or beverages, or both
food and beverages, whether
such food and/or beverages
are served inside a structure
or outside a structure, or
both inside and outside a
structure, that are structurally altered and/or renovated
where the occupancy would
be increased by greater than
20%, as determined by the
Department of Planning
and Development, shall
be permitted only by special exception permit from
the Planning Board, after
the required public hearing except when located in
a Planned Shopping center
over 350,000sf.
Amending§213-348
Parking requirements
There shall be one parking
space for each two stools at
stand-at-counter areas or
one space for each three linear feet of counter (whichever is greater) and one
parking space for each two
seats at tables, plus one space
for each two employees on
the maximum work shift
except when located in a
Planned Shopping center
over 350,000 square feet
when Section 213-286 V
shall apply.
