NOTICE OF PUBLIC HEARING

TOWN OF BABYLON

PLEASE TAKE NOTICE, that the Town Board of the Town of Babylon will hold a Public Hearing at Babylon Town Hall, 200 East Sunrise Highway, Lindenhurst, New York, on the 8th day of December 2010 at 3:30 p.m., prevailing time, regarding certain Fire Protection Contracts and an Ambulance District, as set forth in the annexed Exhibit A

Exhibit A

WHEREAS, present fire protection and ambulance service contracts and an ambulance district contract between the Town of Babylon and various fire companies and departments expires on December 31, 2010; and

WHEREAS, said contracts cover Venetian Shores Fire Protection District #1, North Amityville Fire Protection Districts #5 and #6, East Farmingdale Fire Protection District #12, Wyandanch Fire Protection District #13, North Babylon Fire Protection District #15, North Lindenhurst Fire Protection District #16, West Amityville Fire Protection District #23, West Beach Fire Protection District #53, East Beach Fire Protection District #54 and Wyandanch Wheatley Heights Ambulance District; and

WHEREAS, it is deemed in the best interests of the Town of Babylon to enter into new contracts for fire protection and ambulance service for the aforesaid districts as follows: 1. Venetian Shores Fire Protection District #1:

A contract for a period of one year with the Village of Lindenhurst, said contract having an amount not to exceed $308,000.00 for the year 2011.

2. North Amityville Fire Protection District #5:

A contract for a period of one year with the North Amityville Fire Company, Inc., said contract having an amount not to exceed $883,200.00 for the year 2011.

3. North Amityville Fire Protection District #6:

A contract for a period of one year with the North Amityville Fire Company Inc., said contract having an amount not to exceed $1,270,946.00 for the year 2011.

4. East Farmingdale Fire Protection District #12:

A contract for a period of one year with the East Farmingdale Volunteer Fire Company, Inc., said contract having an amount not to exceed $3,923,500.00 for the year 2011.

5. Wyandanch Fire Protection District #13:

A contract for a period of one year with the Wyandanch Volunteer Fire Company, Inc., said contract having an amount not to exceed $1,322,153.00 for the year 2011.

6. North Babylon Fire Protection District #15:

A contract for a period of one year with the North Babylon Volunteer Fire Company, Inc., said contract having an amount not to exceed $2,904,888.00 for the year 2011.

7. North Lindenhurst Fire Protection District #16:

A contract for a period of one year with the North Lindenhurst Volunteer Fire Department, Inc., said contract having an amount not to exceed $1,624,621.00 for the year 2011.

8. West Amityville Fire Protection District #23:

A contract for a period of one year with the Village of Amityville, said contract having an amount not to exceed $8,000.00 for the year 2011.

9. West Beach Fire Protection District #53:

A contract for a period of three years with the Village of Babylon, said contract having an amount not to exceed $41,197.00 per year for the years 2011, 2012 and 2013.

10.East Beach Fire Protection District #54:

A contract for a period of three years with the Village of Babylon, said contract having an amount not to exceed $82,147.00 per year for the years 2011, 2012 and 2013.

11.Wyandanch-Wheatley Heights Ambulance District:

A contract for a period of one year with the Wyandanch Wheatley Heights Ambulance District, said contract having an amount not to exceed $1,340,872.00 for the year 2011.

RESOLVED, that a Public Hearing be held at Babylon Town Hall, 200 East Sunrise Highway, Lindenhurst, New York, on the 8th day of December, 2010 at 3:30 p.m., prevailing time, on the question of entering into the aforementioned contracts; and be it further

RESOLVED, that the Town Clerk of the Town of Babylon is directed to publish notice of said public hearing in one of the official newspapers of the Town.

All interested persons will be given an opportunity to be heard at the above time and place.

A Local Law amending the Code of the Town of Babylon, Chapter 213, Article I in reference to Zoning.

AMEND: § 2 1 3 - 1 . Definitions and word usage.

BOARDINGHOUSE -- A building or part thereof containing one or more rooming units, which is occupied or intended to be occupied, which is offered or permitted to be used, by the owner, operator, occupant, person in charge, agent or anyone acting on behalf of any of the aforementioned, which is not a motel or hotel, for one or more nights, and sometimes for extended periods of weeks, months and years, where lodging and meals are provided, with or without individual cooking facilities. Nothing herein shall be construed to prevent a natural family or functional equivalent of a natural family from occupying an entire one-family home, a legal accessory apartment or a legal unit in a multifamily dwelling, which by certificate of occupancy is permitted to be used as a multiple-family dwelling.

PRIVATE PROPRIETARY CONVALESCENT HOME -- A facility where lodging, board and health-related services are provided for persons recuperating from illness or incapacity.

PRIVATE PROPRIETARY HOME FOR ADULTS -- An adult care facility, for the purpose of providing temporary or long-term residential care, room, board, housekeeping, personal care and supervision to adults.

PRIVATE PROPRIETARY NURSING HOME -- A facility, other than a hospital, where lodging, board and health-related services are provided for persons with or recuperating from illness or incapacity.

WHEREAS, the Town Board of the Town of Babylon having duly called and held a Public Hearing at Babylon Town Hall, 200 East Sunrise Highway, Lindenhurst, New York, on the 4th day of November, 2010 at 3:30 p.m., on the question of whether it is in the public interest to change the maximum amount to be expended for the Commercial Garbage Improvement Area for 2011, at which hearing all interested persons so desiring were afforded an opportunity to be heard,

NOW, THEREFORE, be it

RESOLVED, by the Town Board of the Town of Babylon that the budget of the Town of Babylon Commercial Garbage Improvement Area for 2011 in the amount of Twenty-Four Million, Six Hundred Twenty Five Thousand, Nine Hundred Thirty and 00/100 ($24,625,930.00) Dollars, which represents a decrease from the amount expended in 2010, be and the same is hereby adopted as the Annual Budget of 2011 Town of Babylon Commercial Garbage Improvement Area.

PEEP SHOW – A theater which presents adult entertainment in the form of live shows, films or videotapes, viewed from an individual enclosure, for which a fee is charged and which is not open to the public generally but excludes any minor by reason of age. However, nothing herein shall permit any enclosure to be more than three sides. One side must be open to the view of other customers.

NOW, THEREFORE, be it

RESOLVED AND ORDAINED, by the Town Board of the Town of Babylon that Local Law No. 33 of 2010, of the Town of Babylon, Suffolk County, New York, is hereby enacted as follows and effective upon its filing with the New York State Department of State: LOCAL LAW NO. 33 OF 2010 A Local Law amending the Code of the Town of Babylon, Chapter 106 in reference to Dogs and Other Animals.

AMEND: § 106-1. Statutory authority.

The licensing of dogs, the enumeration of dogs, the seizure of unlicensed or untagged dogs, the seizure of unleashed dogs, pounds, dog control officers and other related matters are provided for in Article 7 of the Agriculture and Markets Law. The Town Clerk shall have the authority and powers granted to municipalities pursuant to Article 7, Part T of the Agriculture and Markets Law, as amended from time to time, including the setting of all fees associated with this Chapter, as well as, the necessary rules and procedures associated with the administration of this Chapter. Pursuant to the authority contained in such Law, restrictions upon the keeping and running at large of dogs within the Town are provided for in this article.

DELETE: § 106-8. License fees.

ENACT: § 106-8. License fees.

The Town Clerk may establish a schedule of fees, including licensing fees, to be collected for services rendered in connection with the work of her Department and administration of this Chapter and for which she deems it necessary to charge and collect a fee.

AMEND: § 106-25. Public hearing required.

A public hearing shall be held for every application and renewal for special permission. TheBAARC Board shall fix a date, time and place and give public notice thereof by the publication in an officialnewspaper of such hearing at least five days prior to the date of the public hearing. In addition, the BAARC Board shall cause notice to be sent, regular mail, to each adjacent property owner within 300 feet of the outside perimeter of the affected property notifying such owner of the date, place, time and purpose of said public hearing.

AMEND: § 106-26. Application fee.

An application fee, as set by the Town Clerk, will be required upon filing.

AMEND: § 106-27. Babylon Animal Adoption and Rescue Center Board; Duties A. There shall be in the Town of Babylon a Babylon Animal Adoption and Rescue Center (BAARC) Board consisting of six members. Said members shall be the Town Clerk, the Deputy Supervisor, the Commissioner of Environmental Control, the Director of the Animal Shelter, the Comptroller and the Chief Deputy Town Attorney. These members shall serve without compensation.

B. TheCommittee shall meet from time to time, as required and shall set fees, adopt such policies and procedures as necessary for the orderly operation of the Babylon Animal Adoption and Rescue Center and make recommendations and report to the Town Board on applications for special permission and shall advise the Town Board from time to time on issues concerning animal protection.
