LOCAL LAW NO. 22 of 2010 A Local Law adding Chapter 93 to the Code of the Town of Babylon (Board of Grievances and Appeals). ADD: CHAPTER 93 Board of Grievances and Appeals The Town Board finds it necessary and proper to create a board known as the Board of Grievances and Appeals to hear and decide grievances concerning town departments’ handling of Town matters and appeals from any adverse decision from any Town department or division, however, excluding the Assessor’s Office,the Planning Board, the Zoning Board, the Plumbing Board, the prior Non-Conforming Use Board, Sanitation Commission or the Two-Family Review Board § 93-1. Establishment; membership. A. There shall be in the Town of Babylon a Board of Grievances and Appeals (BGA), consisting of the then sitting voting members of the Sanitation Commission. B. No act of the Board of Grievances and Appeals shall be deemed to have become effective unless such action shall have been approved by at least three of the voting members. C. The BGA shall have no authority over labor and employment issues or contractual grievances or criminal violations of the Town Code or tax issues. D. TheBGA will not have authority to hear or decide any issues involving the Tax Assessor’s Office, The Planning Board, TheZoning Board, the Plumbing Board, the Prior Non-Conforming Use Board, the Sanitation Commission or the Two Family Review Board. § 93-2. Powers and duties. The BGA, in addition to the duties prescribed by this chapter and any matter referred to it by resolution of the Town Board, may hear, address and adjudicate said matters, including but not necessarily limited to the following: A. The supervision of any licenses or permits, other than Building Permits, Certificates of Occupancy or any permit/license issued by a Building Inspector or Fire Marshal. Such as, but not limited to: beach permits, boat slips, camping permits, parade permits, dog licenses, etc. B. Theefficiency and reliability of the quality and consistency of the service rendered by them the inhabitants of the Town by Town employees and departments. C. Therental, use and occupancy of any Town owned land, facility or building. D. All licenses awarded pursuant to a Bid or RFP granting license to a nontown entity that may perform certain acts or services or supply certain materials. E. To hear such complaints, grievances and appeals and to order the appropriate remedy. F. To adjudicate violations by imposing fines, penalties and/or conditions, including the suspension or revocation of licensees and privileges on the use or occupancy of Town property or facilities. G. To hear, address and adjudicate appeals from the decision of any commissioner, administrative employee, department or facility. TheBGA may sustain or overturn the decision, order or charge complained of. H. TheBGA shall have the power and authority to create, modify and establish the rules and procedures for appeals to the BGA, hearings regarding said appeals, licensing issues and the administration of Town privileges, licenses, rentals, vendors and the use, enjoyment and occupancy of any Town property or facility. § 93-3. Regulations to be filed with Town Clerk. All rules and regulations adopted by the Sanitation BGA hereunder shall be filed in the officeof the Town Clerk.
