2009 upon the question of enactment of Local Law No. 22 of 2009 of the Town of Babylon, Suffolk County, New York, being a Local Law amending the Code of the Town of Babylon, Chapter 213, Article XVIII, Zoning,

by the Town Board of the Town of Babylon that Local Law No. 22 of 2009, of the Town of Babylon, Suffolk County, New York, is hereby enacted as follows and effective upon its filing with the New York State Department of State: LOCAL LAW NO. 22 of 2009 A Local Law amending the Code of the Town of Bab­ylon, Chapter 213, Article XVIII, in reference to Zoning.

AMEND: §213-236 Repair of damaged buildings; aban­doned or vacant buildings.

The Town board finds that the proliferation of vacant and abandoned buildings, structures and dwellings in the town of Babylon causes a deterioration of communities and areas within the Town of Babylon and has a negative impact on the value of prop­erty in close proximity to the vacant and abandoned build­ings, structures and dwellings. Furthermore, the Town Board finds that vacant and aban­doned

buildings, structures and dwellings have caused a serious threat to the safety and welfare of the residents of the Town and had eroded the quality of life of all who live and work in the Town. Abandoned and vacant build­ings,

structures and dwellings are places of infestation of ro­dents, vermin, insects, wild an­imals and other health threat­ening creatures and diseases, provide shelter to criminals and vagrants who use such places to evade the police and to conduct illicit activities, and are an attractive nuisance to children and adults alike. A. No building or other struc­ture which has been damages by fire or other causes to the extent of more than 50% of its value, exclusive of foundation, shall be repaired or rebuilt except in conformity with the regulations of this chap­ter and the Building Code. B. Vacant or abandoned build­ings, structures and dwellings may not be boarded up, or have the doors, windows, entrances and exits concealed, covered, obscured or hidden in any manner, except in an emer­gency and then for a period not to exceed thirty (30) days. C. Annual registration of vacant buildings and registration fees. 1. Purpose. The purposed of this section requiring the registration of all vacant build­ings, including dwellings as referenced below, and the payment of registration fees is to assist the Town in protect­ing

the public health, safety and welfare, to monitor the number of vacant buildings in the Town, to assess the effects of the condition of those build­ings on nearby businesses and the neighborhoods in which they are located, particularly in light of firesafety hazards and unlawful, temporary oc­cupancy by transients, in­cluding illicit drug users and traffickers, and to require of the owners of such vacant buildings their registration and the payment of related fees, and to promote substan­tial

efforts to rehabilitate such vacant buildings. The provi­sions of this section are ap­plicable to the owners of such vacant buildings as set forth herein and are in addition to and not in lieu of any and all other applicable provisions of this chapter, the health and sanitation code, and any other applicable provisions of the Babylon Town Code.

a. Definitions and applicability; registration statement and fees.

(1) Definitions. For pur­poses of this section, the fol­lowing words and phrases shall have the meanings respective­ly ascribed to them as follows: Boarded — A building or structure subject to the pro­visions of this section shall be deemed to be Boarded if in place of one or more exterior doors, other than a storm door, or of one or more windows, there is a sheet or sheet of plywood or similar material covering the space for such door or window.

Exterior maintenance and major systems — The phrase “exterior maintenance and major systems” shall mean the safe and lawful maintenance of the façade, windows, doors, roof, and other parts of the exterior of the building and the maintenance of its major systems consisting of the roof, the electrical and plumbing systems, the water supply system, the sewer system, and the sidewalk, driveway, if any, and area of the lot.

Occupied — Any building or structure hail be deemed to be occupied if one or more persons actually conducts a lawful business or resides in all or any part of the build­ing as the licensed business occupant, or as the legal or equitable owner/occupant(s) or tenant(s) on a permanent, non-transient basis, or any combination of the same. For purposes of this section, evidence offered to prove that a building is so occupied may include, but shall not be limit­ed to, the regular receipt of de­livery of regular mail through the U.S. Postal Service; proof of continual telephone, electric, gas, heating, water and sewer services; a valid town business license, or the most recent, federal, state, or city income tax statements indicating that the subject property is the officialbusiness or residence address of the person or busi­ness claiming occupancy; or proof of pre-rentai inspection. Open — A building or struc­ture subject to the provisions of this section shall be deemed to be “open” if any one or more exterior doors other than a storm door is broken, open and, or closed but, without a properly functioning lock to secure it, or if one or more windows is broken or not capable of being locked and secured from intrusion, or any combination of the same. e. Owner — An owner of the freehold of the premises of any lesser estate therein, a mortgagee, a vendee-im­posession, assignee of rents, receiver, executor, trustee, lessee, agent or any other person, firm or corporation that is directly or indirectly in control of a building subject to the provisions of this sec­tion, and as set forth below. Vacant — A building or struc­ture shall be deemed to be vacant if no person or persons actually, currently conducts a lawfully licensed business, or lawfully resides or lives in any part of the building as the legal or equitable owner(s) or tenant-occupant(s), or owner-occupant(s), or tenant(s) on a perma­nent, non-transient basis. B. Applicability. The require­ment of this section shall be applicable to each owner of any building that is not a dwelling that shall have been vacant for more than forty-five(45) consecutive days and to each owner of residential property consist­ing

of one or more vacant dwellings that shall have been vacant for more than forty-five(45) consecutive days. Each such owner shall cause to be filed a notarized registra­tion statement, which shall include the street address and parcel number of each such vacant building, the names and addresses of all own­ers, as hereinafter described, and any other information deemed necessary by the Town Clerk. The registration fee(s) as required herein, shall be billed by the Town Clerk and shall be paid by January 1st of each year. For purposes of this section, the follow­ing shall also be applicable: (1) If the owner is a corporation, the registra­tion statement shall provide the names and residence addresses of all officers and directors of the corporation and shall be accompanied by a copy of the most recent an­nual franchise tax report filed with the secretary of state; (2) If an estate, the name and business address of the executor of the estate; (3) If a trust, the name and address of all trustees, grantors, and beneficiaries;

(4) If a partnership, the names and residence addresses of all partners with an interest often (10%) percent or greater;

(5) If any other form of unincorporated associ­ation, the names and resi­dence addresses of all prin­cipals with an interest of ten (10%) percent or greater; (6) If an individual per­son, the name and residence ad­dress of that individual person.

C. Registration statement and fees; local agent. If none of the persons listed, as above, is shown at an address within the state, the registration statement also shall provide the name and address of a person who resides within the state and who is authorized to accept service of process on behalf of the owners and who shall be designated as a responsible, local party or agent, both for purposes of notificationin the event of an emergence affecting the public health, safety or wel­fare and for the purposes of service of any and all notices or registration statements as herein authorized and in con­nection herewith. Registration shall be required for all vacant buildings, whether vacant and secure, vacant and open or vacant and boarded, and shall be required whenever any building has remained vacant for forty-five(45) con­secutive

days or more. In no instance shall the registration of a vacant building and the payment of registration fees be construed to exonerate the owner, agent or responsible party from responsibility for compliance with any other building code or housing code requirement. One reg­istration

statement may be filed to include all vacant buildings of the owner so registering. The owner of the vacant property as of Novem­ber 1st of each calendar year shall be responsible for the payment of the non-refund­able registration fee. Said fee shall be billed by the Town Clerk and based on the dura­tion of the vacancy as deter­mined by the following scale:

(1) $100.00 for properties that are va­cant for less than one year; (2) $500.00 for proper­ties that are vacant for more than one year on the anniver­sary, but less than two years; (3) $1,000.00 for prop­erties that are vacant for at least two years on the anniver­sary, but less than three years; (4) $2,000.00 for proper­ties that are vacant for at least three years on the anniver­sary, but less than fiveyears; (5) $3,500.00 for proper­ties that are vacant for at least five years on the anniversary, but less than ten years; and (6) $5,000.00 for proper­ties that are vacant for at least ten years on the anniversary, plus an additional $500.00 for each year in excess often years.

D. Appeal rights. The owner shall have the right to ap­peal the imposition of the registration fees to the Com­missioner of Planning and Development, upon filing an application in writing with the applicable $50.00 non-refundable filing fee to the Town Clerk no later than thirty (30) calendar days from the date of the billing statement. On appeal, the owner shall bear the burden of providing satisfactory objective proof of occupancy, as definedherein. E. One-time waiver of registra­tion fee. A one-time waiver of the registration fee for up to 90 days may be granted by the Chief Building Inspector upon application of the owner and upon review and advice of the Town Attorney’s Office,within thirty (30) calendar days from the date of the bill for the registration fee, or if denied by the Chief Building Inspector, upon appeal to the Commissioner of Planning and Development, if the owner:

(1) Demonstrate with satisfactory proof that he/she is in the process of de­molition, rehabilitation, or other substantial repair of the vacant building; and (2) Objectively dem­onstrates the anticipated length of time for the de­molition,

rehabilitation, or other substantial repair of the vacant building; or (3) Provides satisfac­tory proof that he/she was actively attempting to sell or lease the property dur­ing the vacancy period; (4) Has paid all past due vacant registration fees and all other financial obliga­tions

and/or debts owed to the Town which are associ­ated with the vacant property. F. Two-year waiver. Upon ap­plication by the owner and satisfaction of subsection (5) above, the licenses and inspection review board may grant a one-time two-year waiver of the registration fee of if denied by the Chief Building Inspector, upon ap­peal

to the Commissioner of Planning and Development, if the owner meets the criteria for non-profit organizations as definedby section 501(c)(3) of the Internal Revenue Code. G. Delinquent registration fees as a lien. After the owner is giv­en notice of the amount of the registration fee due, except for those owners that have properly perfected an appeal as provided above, and the owner fails to pay the amount due, said amount shall consti­tute

a debt due and owing to the Town, and the Town may commence a civil action to collect such the unpaid debt. H. Delinquent regis­tration fees as a lien.

(1) After the owner is given notice of the amount of the registration fee due, except for those owners that have properly perfected an appeal as provided above, and the owner fails to pay the amount due, said amount shall constitute a debt due and owing to the Town; (2) Duty to amend regis­tration statement. If the status of the registration information changes during the course of any calendar year, it is the responsibility of the owner, responsible party or agent for the same to contact the Town Clerk within thirty (30) days of the occurrence of such chang­es and advise the Town Clerk in writing of those changes; (3) Exceptions. This sec­tion shall not apply to any building owned by the United States, the state, the county, nor to any of their respective agen­cies or political subdivisions; (4) Violations; penalties: (a) The failure or refusal for any reason of any owner, or agent of an owner acting on behalf of the owner, to register a vacant building or to pay any fees required to be paid pursuant to the provisions of this section, within thirty (30) days after they become due, shall constitute a violation punishable upon conviction thereof by a finein the amount of not less than $1,000.00 nor more than $15,000.00 for each failure or refusal to register, or for each failure or refusal to pay a required vacant building fee, as appli­cable,

however, the minimum mandatory finefor a violation of this chapter shall not be less than double the amount of the registration fee due and owning. There shall be no unconditional discharges or suspended sentences upon conviction or a plea of guilty to a violation of this chapter and the minimum fines are manda­tory and must be imposed.

by the Town Board of the Town of Babylon that Local Law No. 17 of 2009, of the Town of Babylon, Suffolk County, New York, is hereby enacted as follows and effective upon its filing with the New York State Department of State: LOCAL LAW NO. 17 of 2009 A Local Law amending the Code of the Town of Babylon, Chapter 86, in reference to Boats. AMEND: §86-10 Docking permit application. A. No permit for the mooring of vessels within the Town of Babylon, as provided for in § 86-11 hereof, shall be issued by the Town Clerk unless the applicant therefor shall submit to him/her a written application, sworn to under oath by the applicant, on forms provided for that purpose, setting forth the following facts: (1) That the applicant is the owner of the vessel for which the permit is sought. (2) The name of and the number, if any, assigned by the authorities of the United States of America to the vessel.

(3) That the appli­cant resides within the Town.

(4) That the boat is other­wise in compliance with all fed­eral, state, county and Town laws, codes, ordinances, rules and reg­ulations, including but not limit­ed to New York Navigation Law.

B. No permit for a dock, bulk­heading, pier or wharf, as pro­vided for in § 86-11 hereof, shall be issued by the Town Clerk unless the applicant therefor shall submit to him/her, sworn to under oath by the applicant, on forms pro­vided for that purpose, a state­ment showing the following:

(1) That the applicant is the owner of the vacant prop­erty. For purposes of this sec­tion, "vacant real property" shall be defined as any residential parcel or property which is not improved by a residence or any legal structure uti­lized for residential purposes.

(2) That the Commis­sioner of Planning and De­velopment has approved the issuance of the permit. (3) If known at the time of the application, the names and addresses of the owners of the boats to be docked or placed upon such real property, togeth­er

with the make, model and size of the boats and registration numbers. This information shall be provided by the owner of the property to the Town Clerk as such information becomes available or within 10 days after changes to that information. C. Approval for a dock, bulkheading, pier or wharf; (1) No permit shall be issued under § 86-11 unless the application is first approved by the Commissioner of Plan­ning and Development. In determining whether to ap­prove such application, the Commissioner of Planning and Development shall inspect and consider the following: (a) The quality of the bulkhead, dock, pier or wharf. (b) The safety of the bulkhead, dock, pier or wharf. (c) The length of the dock and/or bulkheading and/or pier and/or wharf.

(d) That the facilities available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service are adequate and in compliance with all federal, state, county and Town laws, codes, ordi­nances, rules and regulations. (e) That the premises is otherwise in compliance with all federal, state, county and Town laws, codes, ordinances, rules and regulations, includ­ing but not limited to New York Navigation Law § 33-c. (f) That the property shall have at least two off-street paved parking areas, plus one addi­tional off-street paved parking area per boat to be docked, two additional off-street paved park­ing spaces for each boat to be placed upon the property, and that the issuance of a permit pur­suant to this section will not oth­erwise result in overcrowding of the parking areas on the street. (2) Based upon the fore­going, the Commissioner of Planning and Development may approve the dock, bulk­heading,

pier or wharf permit and shall specify thereon the number of boats which shall be permitted to dock at or be placed upon the property. AMEND: §86-11. Issuance and Revocation of docking permit. A. If the Town Clerk is satisfied that the applicant is a resident of the Town and possesses the required qualifications, he/she shall issue a permit to the applicant upon pay­ment of such fee therefor as shall be determined from time to time by the Town Board. In the event that an owner or person in charge of a boat or personal water craft is in violation of this chapter or fails to comply with all fed­eral, state, county and Town laws, ordinances, rules, regula­tions and codes respecting the docking of boats, the Commis­sioner of Parks, Recreation and Cultural Affairs may revoke the permit granted hereunder. C. In the event that an owner or person in charge of a dock, bulkheading, pier or wharf is a violation of this chapter or fails to comply with all federal, state, county and Town laws, ordinances, rules, regulations and codes respecting the dock­ing

of boats, the Commissioner of Planning may revoke the permit granted hereunder.

148-1: LEGISLATIVE INTENT: The Town Board finds it nec­essary to protect the public from establishments, which are unlicensed, from per­forming massages on unsus­pecting persons and from establishments operating under the guize of being a massage establishment, when actually engaging in illegal behavior and subjecting the public to exposure of un­clean, unhealthy and possibly contaminated conditions.

148-2: DEFINITIONS. For the purposes of this Article: Town - means the Town of Babylon. Massage - means any meth­od of pressure on or friction against, or stroking, kneading, rubbing, tapping, pounding, vibrating, or stimulating of the external soft pads of the body with the hands or with the aid of any mechanical electrical apparatus or appliances, with or without such supplemen­tary

aids as rubbing alcohol, liniments, antiseptics, oils, powder, lotions, ointments, or other similar preparations. Massage establishment - means a fixed place of busi­ness where more than one person engages in or car­ries on, or permits to be engaged in or carried on, the practice of massage. Massage practitioner - means any individual who, for any monetary consideration what­soever, engages in the prac­tice of massage. "Massage practitioner" shall include all massage practitioners.

Permittee - means the owner, proprietor, manager, or op­erator of a massage estab­lishment, outcall massage service, or solo practitioner massage establishment.

Person - means any individual, partnership, firm, association, company, corporation, or combination of individuals of whatever form or character. Recognized school for mas­sage - requires graduation from a school or institute of massage therapy with a program registered by the Department of Education of the State of New York, or its substantial equivalent in both subject matter and extent of training, provided that the program in such school or institute shall consist of class­room

instruction of a total of not less than five hundred hours in subjects satisfactory to the department and upon completion must: pass an ex­amination satisfactory to the state board for massage thera­py and in accordance with the Commissioner’s regulations; Solo practitioner massage establishment - means a fixed place of business where a person holding an advanced massage practitioner permit engages in or carries on, or permits to be engaged in or carried on, the practice of massage. Said fixed place of business may be shared by two to four advanced massage practitioners, or two to four advanced massage practitio­ners

and one or more health or healing arts practitioners, except as otherwise provided pursuant to Section 1913(e).

148-3: M A S S A G E ESTABLISHMENTS. No massage establishments may be open, operate, ex­ist or be occupied within the Town of Babylon, ex­cept as provided herein: A. The massage establishment and any massage practitioner working or practicing or oc­cupying

the establishment has first obtained a license pursuant to New York State Education Law Article 155, after graduation from a rec­ognized school for massage; and further provided that: B. The use is so located that the premises upon which it is con­ducted are not less than 1,000 feet from the premises of any other massage establishment; and further provided that: C. The following standards and conditions are met: (1) the hours of operation of the mas­sage activity shall be limited to from 8:00 a.m. to 9:00 p.m..; (2) there shall be no outdoor activity associated with the massage activity or establish­ment (3) all refuse, garbage, waste, solid or otherwise, shall be properly disposed of, laundry shall be changed after each massage/client, laundry shall be cleaned on a daily basis during the days the establishment is in operation, all rooms, tables, etc. shall be sanitized daily and all massage practitioners shall sanitize their hands prior to perform­ing a message; and (4) there shall be no alcoholic bever­ages served on the premises; (5) change in ownership or change in operation of the massage establishment re­quires a new Permit and shall be required to meet these standards and conditions. 148-4: EXEMPTIONS: Nothing contained in this article shall be construed to prohibit:

A. The practice of massage therapy by any person who is authorized to practice medi­cine,

nursing, osteopathy, physiotherapy, chiropractic, or podiatry in accordance with the provisions of this title. B. The practice of that mas­sage which is customarily giv­en in barber shops or beauty parlors for the purpose of beautificationby any licensed barber or beauty culturist.

C. The practice of massage therapy by any person em­ployed in a medical institu­tion licensed or chartered by the state of New York, provided that such person is under the on-site supervi­sion of a person licensed to practice massage therapy or authorized to practice mas­sage therapy by subdivision one of this section, or by any person enrolled in a program of a school or institute of mas­sage

therapy registered by the department, or enrolled in a program which satisfies the requirements of section seventy-eight hundred four of this article, provided that such person is under the on-site supervision of a person licensed to practice massage therapy or authorized to prac­tice massage therapy by sub­division one of this section. D. The practice of massage therapy by any person duly employed as a trainer by a pro­fessional athletic association, club or team, or as a member of the physical education de­partment of an accredited uni­versity, college or high school. E. The practice of massage therapy by any person em­ployed by a corporation or association organized ex­clusively for the moral or mental improvement of men, women or children. F. Where the only massage service provided is a chair mas­sage, such service is visible to the public, and customers are fully-clothed at all times, said premises shall not be consid­ered a massage establishment.

AMEND: §170-61. Re­stricted plumber's license.

A. Notwithstanding anything herein contained to the con­trary, a person may engage in any of the businesses or occupations described below within the Town, provided that he shall first have ob­tained

a license known and designated as a "restricted plumber's license for (desig­nated occupation)" from the Plumbers' Examining Board. B. The plumbing work per­mitted under a restricted plumber’s license is limited to the plumbing work nec­essary

and solely related to the operation, installation, maintenance and repair of the equipment associated with the field for which the restricted plumber’s license is specificallyissued. Modifica­tions to existing plumbing systems are permitted pro­vided that such modifications are no more than ten (10) feet from the equipment being in­stalled,

maintained or repaired unless specified under specific occupation or business license in paragraph C. All plumbing work within this license clas­sification must conform to the applicable standards of the Town of Babylon or to the New York State Plumbing Code.

C. The occupations or busi­nesses for which a restrict­ed plumber's license shall be issued are as follows: (1) Fire sprinkler sys­tems: limited to the installation of fire sprinkler systems, nec­essary

appurtenances thereto and such piping necessary to bring water to the system.

(2) Heating: limited to the installation of furnaces, burners, boilers and radiation oil tanks and all component parts and piping, includ­ing water piping within a radius of six feet of a boiler. (3) Air conditioning and refrigeration: limited to the installation of all air-con­ditioning

and refrigeration equipment and water con­nections to those units only. (4) Electric sewer clean­ing: limited to the cleaning of waste lines and removal of such sections of same in order to complete service. This does not permit any altera­tion of any existing drainage. (5) Gas tank installers: limited to the installation of storage tanks for gasoline, propane and similar fuels both above and underground. (6) Underground sprinkler systems: limited to the installation of under­ground sprinkler systems for landscaping purposes. (7) Air conditioning and heating: limited to the instal­lation of all air-conditioning equipment and water connec­tions to those units only, as well as the installation of furnaces, burners, boilers and radiation oil tanks or gas supply and all component parts and piping, including water piping within a radius of six feet of a boiler. (8) LP Gas: limited to the installation, repair, altera­tion, maintenance or erection of piping and apparatuses in connection with LP gas burning equipment. A LP gas licensee may perform the following acts: furnish and/or install, repair, maintain, alter or erect LP gas burning equipment and components which include LP gas storage tanks, LP gas piping, LP gas burner equipment and all other LP gas appurtenances. A LP licensee may not perform the following acts: direct connections to water sup­ply

systems, waste and/or drainage systems and natural gas installations and service. (9) Well driller: limited to the drilling of the well pip­ing into pneumatic tanks, hook-up water pumps and tank. A well driller licensee may not perform the following acts: the installation of any wa­ter piping within the building.
