NOTICE OF SPECIAL DISTRICT MEETING OF THE COPIAGUE UNION FREE SCHOOL DISTRICT, IN THE COUNTY OF SUFFOLK, NEW YORK. NOTICE IS HEREBY GIVEN that pursuant to a resolution of the Board of Education of Copiague Union Free School District, in the County of Suffolk, New York, adopted on September 3, 2009, a Special District Meeting of the qualified voters of said School District will be held on Tuesday, October 27, 2009 from 10:00 o’clock A.M. to 9:00 o’clock P.M. (Prevailing Time) at the Copiague Memorial Public Library, 50 Deauville Boulevard, Copiague, New York, for the purpose of voting upon the following Library Bond Proposition:

LIBRARY BOND PROPOSITION RESOLVED: (a) That the Board of Education of the Copiague Union Free School District, in the County of Suffolk, New York (the “District”), is hereby authorized to partially reconstruct and construct alterations and improvements to the Copiague Memorial Public Library (the “Project”) substantially as referred to and described in a summary prepared with the assistance of John A. Grillo, Architects, (the “Summary”), which Summary is on fileand available for public inspection at the Copiague Memorial Public Library, including the construction of a partial second floor within the existing Library structure to provide for additional adult room reading space, computer space, group meeting space and individual study spaces; the foregoing to include associated HVAC, handicapped accessibility and structural improvements, and all original furnishings, equipment, machinery, apparatus and all ancillary or related work required in connection therewith; and to expend therefor, including preliminary costs and costs incidental thereto and to the financing thereof, an amount not to exceed the estimated maximum cost of $1,865,000; provided that the detailed costs of the components of the Project as set forth in detail in the Summary may be reallocated among such components if the Board of Education shall determine that such reallocation is in the best interests of the District; (b) that $365,000 currently available in the Copiague Memorial Public Library’s capital reserve fund is hereby authorized to be expended and applied to pay a portion of said estimated maximum cost; (c) that a tax is hereby voted in the aggregate amount of not to exceed $1,500,000 to finance the balance of said estimated maximum cost, such tax to be levied and collected in installments in such years and in such amounts as may be determined by said Board of Education; and (d) that in anticipation of said tax, bonds of the District are hereby authorized to be issued in the aggregate principal amount of not to exceed $1,500,000 and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable.

Such Library Bond Proposition shall appear on the ballot labels to be inserted in the voting machines used for voting at said Special District Meeting in substantially the following condensed form: LIBRARY BOND PROPOSITION YES

N O RESOLVED: (a) That the Board of Education of the Copiague Union Free School District, in the County of Suffolk, New York, is hereby authorized to partially reconstruct and construct alterations and improvements to the Copiague Memorial Public Library and to expend therefor an amount not to exceed $1,865,000; (b) that $365,000 currently available in the Library’s capital reserve fund is hereby authorized to be expended and applied to pay a portion of said cost; (c) that a tax is hereby voted in the amount of not to exceed $1,500,000 to finance the balance of said cost, such tax to be levied and collected in installments in such years and in such amounts as may be determined by said Board of Education; and (d) that in anticipation of said tax, bonds of the District are hereby authorized to be issued in the aggregate principal amount of not to exceed $1,500,000 and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable. The voting will be conducted by ballot on voting machines as provided in the Education Law and the polls will remain open from 10:00 o’clock A.M. to 9:00 o’clock P.M. (Prevailing Time) and as much longer as may be necessary to enable the voters then present to cast their ballots. NOTICE IS FURTHER GIVEN that voter registration for the District is ongoing until October 20, 2009, from 9:00 o’clock A.M. until 3:00 o’clock P.M. (Prevailing Time), Monday through Friday, excluding legal holidays, at the office of the District Clerk, Central Administrative Office,2650 Great Neck Road, Copiague, New York, for the purpose of preparing a register of the qualified voters of the school district for said Special District Meeting, at which time any person shall be entitled to have his/ her name placed upon such register, provided that he/ she is known or proven to the satisfaction of such Board of Registration to be then or thereafter entitled to vote at said Special District Meeting. The register of the qualified voters of said School District prepared for the Annual Meeting and Election held on May 19, 2009 shall be used by said Board of Registration as the basis for the preparation of the register for said Special District Meeting to be held on October 27, 2009. Any person whose name appears on such register or who shall have been previously registered for any Annual or Special District Meeting or election and who shall have voted at any annual or special meeting or any election held or conducted at any time since January 1, 2005, will not be required to register personally for this Special District Meeting. In addition, any person otherwise qualified to vote who is registered with the Board of Elections of Suffolk County under the provisions of the Election Law, shall be entitled to vote at said Special District Meeting without further registration. Immediately upon its completion, said register will be filed in the office of the District Clerk and will be open for inspection by any qualified voter of the District on each of the five days prior to the day of the election, Sunday and legal holidays excepted, between the hours of 9:00 o’clock A.M. and 4:00 o’clock P.M. (Prevailing Time) and on Saturday, October 24, 2009, by appointment only. NOTICE IS FURTHER GIVEN that applications for absentee ballots may be applied for at the officeof the District Clerk. If the ballot is to be mailed to the voter, the completed application must be received by the Clerk of the District no later than 4:00 o’clock P.M. on October 20, 2009. If the ballot is to be delivered personally to the voter, the completed application must be received by the District Clerk no later than 4:00 o’clock P.M. (Prevailing Time) on October 26, 2009. No absentee voter’s ballot will be canvassed unless it has been received in the office of the District Clerk not later than 5:00 o’clock P.M. (Prevailing Time) on the date set for the Special District Meeting. A list of all persons to whom absentee ballots shall have been issued will be available in the officeof the District Clerk on each of the fivedays prior to the day of the election, Saturday, Sunday and legal holidays excepted, between the hours of 9:00 o’clock A.M. and 4:00 o’clock P.M. SYNOPSIS OF DETERMINATIONS AND FINDINGS OF GEOFF MASCARO, AS HEARING OFFICER DULY DEISGNATED BY THE COMMISSIONER OF THE SUFFOLK COUNTY DEPARTMENT OF PUBLIC WORKS PURSUANT TO SECTION 204 OF THE NEW YORK STATE EMINENT DOMAI N PROCEDURE LAW

Pursuant to New York State Eminent Domain Procedure Law Section 201, on June 30, 2009, a hearing regarding the above-entitled project was held to inform the public about said project and to review the public use to be served by the project and to determine the impact of the project upon the environment and upon the residents of the locality where said project will be constructed.

On September 2, 2009, the Condemnor, to wit: The County of Suffolk, by GEOFF MASCARO, as Hearing Officer duly designated by the Commissioner of the Suffolk County Department of Public Works made its Findings and Determinations based upon said hearing. Furthermore, on September 4, 2009, said Findings and Determinations, together with the Minutes and Exhibits of the Hearing, will be duly filed in the Office of the Clerk of the Suffolk County Legislature.

A copy of the Findings and Determinations will be forwarded to any interested person without cost upon written request to: Clerk of the Suffolk County Legi s latur e William Rogers Bldg. PO Box 6100 Hauppauge, NY 11788-0099 Under Section 207 of the New York State Eminent Domain Procedure Law, there are thirty (30) days from the completion of the Condemnor’s newspaper publication requirement to seek judicial review of the Condemnor’s Determinations and Findings. Under Sections 207 and 208 of the New York State Eminent Domain Procedure Law, the exclusive venue for Judicial Review of the Condemnor’s Determinations and Findings is the Appellate Division of the Supreme Court in the Judicial Department where any part of the property to be condemned is located.

The synopsis of said Findings and Determinations of GEOFF MASCARO, as Duly Designated Hearing Officer by the Commissioner of the Suffolk County Department of Public Works, is as follows: a. That the proposed acquisition of the parcel owned by the Metropolitan Transportation Authority (Proposed Acquisition Map Number 15) pursuant to the provisions of the Eminent Domain Procedure Law is not authorized by said statute because said Authority is a governmental entity higher than the County of Suffolk and may only be acquired by a voluntary transaction with said property owner.

b. That the proposed acquisition of the parcels owned by the Pinelawn National Cemetery (Proposed Acquisition Maps Numbered 13, 14, 16, 17, and 18) is specifically exempt from acquisition under the provisions of the New York State Eminent Domain Procedure Law by operation of New York State Not-For- Profit Corporation Law §1506 and may only be acquired by a voluntary transaction with said property owner.

c. That the remainder of the proposed project, as recommended by the Suffolk County Department of Public Works may be acquired Under the Provisions of the New York State Eminent Domain Procedure Law but no acquisition of said properties should be made unless or until Proposed Acquisition Maps 13, 14, 15, 16, 17, and 18 are acquired by Voluntary Acquisition or other rrangements are made by DPW to accommodate the needs of the project.

Additionally, if it is determined by the Department of Public Works from an engineering standpoint that it is feasible and desirable for one or more parcels of land to be conveyed to the County by donation in lieu of acquiring Proposed Acquisition Maps 9, 10, and 19 (the Woodbourne Nursery Parcels) by eminent domain, a reasonable effort should be made to accommodate said request provided that it does not violate any of the Federal and New York State legal and funding mandates of this project.

d. That the public, use, benefit, or purpose to be served by the proposed public project is to reduce the accident rate, reduce traffic delay times, and reduce traffic congestion. . e. That the approximate location for the proposed public project is the intersection of County Road 3 at Colonial Springs Road in the Town of Huntington, Suffolk County, New York as well as the intersection of County Road 3 at Long Island Avenue and Conklin Street in the Town of Babylon, Suffolk County, New York.

f. That the reason for selecting this location is that studies and meetings disclosed the following deficiencies must be resolved: 1) Accident rates that are above the County average; 2)Poor levels of serv at both intersections; 3) Excessive traffic delay times especially at the Babylon intersection; 4)Insufficient draina ge facilities; 5) Failing roadway sections such as rutting, cracking, and poor delaminating of the existing asphalt pavement; and 6) Poor stopping site distances.

g. That the general effect of the proposed project on the environment is non-significant because:

1) The proposed action will not exceed any of the criteria in Title 6 NYCRR Section 617.7, which sets forth thresholds for determining significant effect on the environment, as demonstrated in the Environmental Assessment Form;

2) The proposal does not appear to significantly threaten any unique or highly valuable environmental or cultural resources as identified in or regulated by the Environmental Conservation Law of the State of New York or the Suffolk County Charter or the Suffolk County Code;

3) The parcel does not appear to suffer from any severe environmental development constraints (no poor soil properties, no high groundwater and no unmanageable slopes);

4) Existing drainage problems will be alleviated; and

5) Traffic safety will be improved and traffic congestion

mitigated.

This determination is supported by Suffolk County Resolution Number 981-2008 issuing a SEQRA determination of Non-significance (negative declaration) on December 15, 2008 for the proposed C.R. 3, Pinelawn Road / Wellwood Avenue Intersection Reconstruction, Towns of Babylon and Huntington, Suffolk County New York, CP 5510, that this location be considered as an Unlisted Action under SEQRA and that a determination of Non-significance was issued.

h. That the general effect of the proposed project on the residents of the locality is positive because it will provide reduce traffic delay times and traffic accidents in the Acquisition area.

i. That another factor considered in deciding to approve the proposed project is that fewer vehicles will be idling in traffic and thus local air quality will be improved.
