RESOLVED, by the Town Board of the Town of Babylon that the request for an amendment to Covenants and Restrictions on Application #06-60AE, change of zone from "GA" Industry and "A" Residence to Multiple Residence, by VMD Development Corporation, (the "Petitioners") be and the same hereby is granted, subject to the following amended Covenant and Restriction No. 6: 6. Eight (8) units which constitutes twenty percent (20%) of the units shall be designated as work force/affordable housing and the owner/applicant shall contribute $520,000 ($65,000 per unit) into the Affordable Housing Fund in lieu of designating eight (8) units prior to the issuance of any Certificate of Occupancy for said project. Two (2) units shall be handicapped adaptable. and be it further

RESOLVED, that in case of any violation or attempted violation of any of the covenants by the owners or their lessees and failure of the owners to remedy any such violation within thirty (30) days after written notice by the Town, the Town shall have the right, on its own motion and after notice, to rescind said change of zone and the subject premises shall revert from Multiple Residence to "GA" Industry and "A" Residence, and be it further

RESOLVED, that if the owners hereto, or any of them, their lessees, their heirs, successors, or assignees shall violate or attempt to violate any of the covenants or conditions required by the granting of this permit, it shall be lawful for the Town of Babylon to prosecute any proceedings at law or in equity, including but not limited to enforcement by way of injunctive relief; any remedies chosen by the Town Board to enforce any covenant, restriction or condition herein shall be cumulative and at the discretion of the Town Board as to how best to enforce such covenant, restriction or condition; the election of one method of enforcement shall not constitute a bar to electing any other method of enforcement permitted by law, and be it further,

A Local Law amending the Code of the Town of Babylon, Chapter 74, in reference to Alcoholic Beverages.

AMEND:§74-3. Con- sumption in public.

It shall be a violation of this chapter for any person to:

A.Consume any alco- holic beverage in any public place within the Town.

B. Have in his possession an open or unsealed container of an alcoholic beverage while in any public place.

AMEND:§74-5. Pen- alties for offenses.

Any person found guilty of violating this chapter shall be guilty of a Class B Misdemeanor and, upon conviction thereof, a fine of not less than $250 nor more than $1,000 must be imposed or a term of imprisonment for a period not to exceed 90 days may be imposed, or both, for conviction of a first offense; for conviction of a second offense, both of which were committed within a period of five years, shall be guilty of a Class B Misdemeanor, and upon conviction a fine not less than $1,000 nor more than $2,500 must be imposed or a term of imprisonment for a period not to exceed 90 days may be imposed, or both; and, upon conviction for a third or subsequent offense, all of which were committed within a period of five years, shall be guilty of a Class B Misdemeanor and a fine not less than $2,500 nor more than $5,000 must be imposed or a term of imprisonment for a period not to exceed 90 days may be imposed, or both.

RESOLVED AND ORDAINED, by the Town Board of the Town of Babylon that Local Law No. 2 of 2008, of the Town of Babylon, Suffolk County, New York, is hereby enacted as follows and effective upon its filing with the New York State Department of State: LOCAL LAW NO. 2 of 2009

A Local Law amending the Code of the Town of Babylon, Chapter 106, Article IV, in reference to Dogs and Other Animals.

AMEND:§106-30. Regula- tions; penalties for offenses.

A. It shall be unlawful for the owner of any deceased animal weighing more than five pounds at the time of its death to abandon or to dispose of its remains other than by:

(1) Delivery thereof to a licensed veterinarian who consents to accept such deceased animal and who shall dispose of the animal by delivery thereof to a regulated pet crematory or pet cemetery; or (2) Delivery thereof to a regulated pet crematory or pet cemetery who consents to accept such deceased animal; or (3) The owner of any such deceased animal may arrange for the disposal of such animal by the Town Department of Environmental Control who shall charge the owner of such animal a fee which shall be established by Town Board resolution.

B. A violation of section A is a violation, and, upon conviction thereof, a fine of not less than $250 and not more than $1,000 must be imposed or imprisonment for a period not to exceed 15 days, or by both.

C. A person being the owner or possessor, or having charge, custody or possession of an animal, who abandons such animal, or leaves it to die in a street, road or public place, or who allows such animal, if it become disabled, to lie in a public street, road or public place more than three hours after he knew or should have know that it is left disabled, is guilty of a class A Misdemeanor, and, upon conviction thereof, a fine of not less than $500 and not more than $5000 must be imposed or imprisonment for a period not to exceed one year, or by both.

§ 1 0 6 - 30.1 Definitions.

As used in section C, the following terms shall have the meanings indicated:

ABANDON: to leave an animal unattended; for any period of time without water or for more then 5 hours without food or for any period of time on any property without permission of the owner of said property or for any period of time on public property or for any period of time on any property when said animal is sick, malnourished, disabled, incapacitated, emaciated, debilitated or injured. Nothing herein shall prohibit an animal owner from leaving an animal for less then an 30 minutes on public property while engaged in an activity in the immediate proximity of the animal, such as at a park, ball field, etc., while engaged as a participant or spectator of activities.

UNATTENDED: without the owner or possessor, or person having charge, custody or possession of an animal: in close proximity to listen or observe said animal; not cared for: not taken care of or seen to; not escorted: not accompanied.

WHEREAS, the owners of land on both sides of that portion of Barry Road to be discontinued have requested the discontinuance thereof by written petition to the Commissioner of the Department of Public Works of the Town of Babylon,

NOW, THEREFORE, be it

RESOLVED, that consent is given that the Town of Babylon Commissioner of the Department of Public Works shall file and cause to be recorded in the Town Clerk's Office an Order directing that said portion of Barry Road be discontinued and abandoned for public purposes pursuant to Highway Law Section 207; and be it further
