It shall be immaterial whether the dwelling units are occupied or vacant. B. It shall be unlawful for any person to allow, permit or suffer the existence of an accessory apartment and/or accessory kitchen without first obtaining and maintaining a valid accessory apartment permit or accessory kitchen permit. C. The presence or existence of any of the following shall create a rebuttable presumption that a premises is occupied by more dwelling units than permitted by the certificate of occupancy: (1) Multiple persons living in premises represent that they are not the owner and/or pay rent to the owner of the premises. (2) Utilities, cable, phone or other services are in place or requested to be installed or used at the premises by multiple dwelling units. (3) Testimony by a witness that it is common knowledge in the community that multiple family units exist in premises. (4) There is more than one mailbox at the premises. lease or rental arrangement, payment or agreement for portions of the dwelling among its owner(s) and/or occupants and/or persons in possession thereof. (10) The inability of any occupant or person in possession thereof to have unimpeded and/or lawful access to all parts of the dwelling unit. (11) Two or more kitchens or one or more of the following: a range, oven, hotplate, microwave or other similar device customarily used for cooking or preparation of food and/ or a refrigerator. D. Nothing herein shall be construed to prevent persons living together as a family unit, with the owner, as defined by this Code. AMEND: §153-29 Penalties for offenses. A. Any person who shall allow, permit or suffer the existence of more dwelling units then permitted by the last Certificate of Occupancy issued for said property, on any property within the Town of Babylon, shall be guilty of a misdemeanor and upon conviction thereof, shall be punishable by a fine of not less than $5,000 and not more than $10,000 or imprisonment for a period not to exceed one year, or both. Upon application of the Town Attorney's office (Special Assistant District Attorney) a violation of this chapter may be reduced to an "attempted violation" as established by the New York State Penal Law §1 10.00. Penalties for the reduced charge of attempt shall be: (1) Any person who shall attempt to violate any of 153-28 A, of this chapter shall be guilty of a violation and, upon conviction thereof, a fine of not less than $2500 nor more than $5000 must be imposed and a term of imprisonment for a period not to exceed 30 days or both. NOTICE IS HEREBY FURTHER GIVEN that the Board of Education shall hold a Public Hearing for the purpose of discussing the expenditures of funds and the budgeting thereof at the McKenna Administration Building on May 7, 2008 at 8:00 P.M., time then in effect. NOTICE IS HEREBY FURTHER GIVEN that a copy of the statement of the amount of money which will be required for the ensuing year for school purposes, together with the text of any resolution which will be presented to the voters, may be obtained by any resident in the District during the fourteen (14) days immediately preceding the annual meeting and election except Saturday, Sunday or holidays, at the School District Administration Office, 350 Daniel Street, Lindenhurst, New York, and at each school in the District, between the hours of 9:00 A.M. and 4:00 P.M., time then in effect. NOTICE IS HEREBY FURTHER GIVEN that the petitions nominating candidates for the office of member of the Board of Education must be filed with the District Clerk of the District not later than April 21, 2008 at 5:00 P.M. The following vacancies on the Board of Education are to be filled: Term Last Incumbent Three Years, July 1, 2008 to Robert Brandenberger June 30, 2011 Three Years, July 1, 2008 Edward J. NOTICE IS HEREBY FURTHER GIVEN that at the said annual election and vote, to be held as aforesaid on May 20, 2008, the following propositions will be submitted for the purpose of voting thereon by voting machine between the hours of 6:00 A.M. and 9:00 P.M., time then in effect. Notice of the deadline for filing nominating petitions for school board trustee must be published in the notice of annual meeting. The law requires that the deadline be thirty (30) days prior to the election. PROPOSITION NO 1 BUDGET PROPOSITION Shall the following resolution be adopted, to wit: RESOLVED, that the Board of Education of Lindenhurst Union Free School District is hereby authorized to expend during the school year 2008- 2009 the sum set forth in the Budget Estimate for the school year 2008-2009, heretofore filed pursuant to law, and that the Board of Education be authorized to levy the necessary tax therefor. NOTICE IS HEREBY FURTHER GIVEN that, pursuant to Section 2014 of the Education Law, personal registration of voters is required for said annual election and vote, and no person shall be entitled to vote at the annual election and vote to be held as aforesaid, whose name does not appear on the register of said School District prepared as hereinafter set forth, except a person who is otherwise qualified to vote and is registered under provision of Article 5 of the Education Law. NOTICE IS HEREBY FURTHER GIVEN, that personal registration of voters is required either pursuant to §2014 of the Education Law or pursuant to Article 5 of the Education Law. If a voter has heretofore registered pursuant to §2014 of the Education Law and has voted at an annual or special district meeting or any school district election held or conducted within the last four (4) calendar years, he/she is eligible to vote at this election; if a voter is registered and eligible to vote under Article 5 of the Education Law, he/she is also eligible to vote at this election. All other persons who wish to vote must register. AMEND: §1-21 Penalties for offenses. A. Any person who fails to respond to a summons shall be guilty of a violation and, upon conviction thereof, a fine of not less than $250 nor more than $1,000 must be imposed and a term of imprisonment for a period not to exceed six months may be imposed, or both, for a first offense; a fine not less that $1,000 nor more than $2,500 must be imposed and a term of imprisonment for a period not to exceed six months may be imposed, or both, for a second offense within five years of a conviction; and a fine not less that $2,500 nor more than $5,000 must be imposed and a term of imprisonment for a period not to exceed six months, or both, for a third offense within five years of the first conviction. B. Any person who shall resist or obstruct a duly authorized officer, agent or employee of the Town in their performance of their duties, shall be guilty of a Class A misdemeanor and, upon conviction thereof, a fine of not less than $1,000 nor more than $2,500 must be imposed or imprisonment for a period not to exceed one year, or both such fine and imprisonment. The mandatory minimum fine must be imposed and there shall be no discretion in imposing the mandatory minimum fine; no unconditional discharge or any other sentence which does not include the mandatory minimum fine or term of imprisonment may be imposed, except upon application of the Special Assistant District Attorney and consent of the court. Each instance of obstruction or resistance shall constitute a separate offense hereunder.
