PUBLIC NOTICE NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF DETERMINATION OF NON-SIGNIFICANCE; FINAL FLOODPLAIN NOTICE; NOTICE OF REQUEST FOR RELEASE OF FUNDS TOWN OF BABYLON 9-11 HOMETOWN MEMORIAL FOUNDATION EDUCATION CENTER AUGUST 21, 2008 Name of Responsible Entity and Recipient: The 9-11 Hometown Memorial Foundation Inc. These notice satisfy three procedural requirements for activities to be undertaken by the Foundation. TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS: Notice of Finding of No Significant Impact and Determination of Non-Significance (FONSI Notice): The Foundation, as Lead Agency under the National Environmental Policy Act (NEPA) and State Environmental Quality Review Act (SEQRA) has prepared an Environmental Assessment for the Town of Babylon 9-11 Hometown Memorial Foundation Education Center. The Foundation has determined that the project will have no significant impact on the environment. Therefore, an Environmental Impact Statement under NEPA and SEQR is not required. Additional project information is contained in the Environmental Assessment (EA) on file at Babylon Town Hall, 200 East Sunrise Highway, Lindenhurst, N.Y. 11757 and the Babylon Town Hall Annex, 281 Phelps Lane, North Babylon, N.Y. 11703. The EA can be reviewed on weekdays between 10:00 a.m. and 4:00 p.m. Notice for Final Public Review of a Proposal in the 100-year Floodplain: This notice also serves as the Notice for Final Public Review of Proposal in the 100-Year Floodplain. This notice is provided pursuant to Section 2(a)(4) of Executive Order 11988 for Floodplain Management and 24 CFR §55.20(b) concerning financial assistance for activities that are within and/or affect a floodplain. The Foundation has determined that the Memorial Project will not adversely affect the floodplain's ability to contain floodwaters or exacerbate flooding conditions on the project site or its immediate vicinity. The Foundation has also determined that there is no alternative location for the Memorial Project and intends to submit a request for funds to HUD as described above. The acreage of the project that is located in the 100- year floodplain is approximately sixteen hundredths of an acre (or 7,000) square feet). Notice of Intent to Request Release of Funds: On or about September 5, 2008, the Foundation will submit a request for the Memorial Project to HUD for release of FY 2006 EDI-Special Project Grant Funds under Title 1 of the Transportation, Treasury, Housing and Urban Development, the Judiciary, the District of Columbia, and Independent Agencies Act, 2006. If approved, the Memorial Project, located at Cedar/Overlook Beach, Ocean Parkway, Babylon, will include a 7,000 square foot outdoor plaza with an Open Pavilion, Eternal Light Sculpture, Foundation with Waterfall, and a Memorial Walkway. The Walkway displays 48 engraved granite plaques, dedicated to a Babylon resident lost in the September 11, 2001 attack. The Foundation is requesting $247,500.00 in funding. Release of Funds: The Foundation certified to HUD that Thomas Vetri consent to accept the jurisdiction of the Federal Courts, if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities sunder NEPA and related laws and authorities, and allows the Foundation to use EDI Program funds. Objections to Release of Duns: HUD will accept objection to its release of funds and the Foundation's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Name of RE; (b) the Foundation has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the HUD Grant Administration Office at Jacob K. Javits Federal Building, 26 Federal Plaza, Room 3541, New York, N.Y. 10278- 0068. Potential objectors should contact HUD to verify the actual last day of the objection period. Public Comments: Written comments on the FONSI Notice, Floodplain Notice or Notice of Request for Release of Funds may be submitted to the Foundation and must be received by 4:30 p.m. on Friday, September 5, 2008 or they will not be considered. The Foundation will consider all comments received by this date, prior to authorizing the submission of its Request for Release of Funds to HUD.
