WHEREAS, the Declaration reserved the right to terminate the restrictive covenant only upon prior approval of the Town Board of the Town of Babylon; and

WHEREAS, certain provisions of Resolution 125 (specifically paragraph 5) are not applicable to the current owners of condominium units located on the premises; and

WHEREAS, on or about December 5, 1997, the Board of Managers of the Polo Club Condominium and certain unit owners residing at the Polo Club Condominium commenced a civil action against the Town of Babylon for various relief; and

WHEREAS, the abovementioned action was commenced in Supreme Court, Suffolk County under Index No. 97-29974; and

WHEREAS, on or about April 2, 2004 the Town of Babylon commenced a third-party action against Oaks Development Corp. d/ b/a Laurel Oaks Associates, Laurel Oakes Associates, Laurel Development Corp., Wilbur Breslin and Donald Monti for indemnification and contribution; and

WHEREAS, the Town Board wishes to settle the above actions in accordance with the terms set forth in the settlement agreement to be executed by the parties; and

WHEREAS, the authorization of the settlement of legal action is a Type II action pursuant to 6 N.Y.C.R.R. §617.5(c)(29) and therefore no further SEQRA review is required, NOW, THEREFORE, be it

WHEREAS, in accordance with Section 617.5(c)(20) State Environmental Quality Review, the amendment to Chapter 213-1 of the Code of the Town of Babylon in reference to standards for decks involves routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment,

NOW, THEREFORE, be it

A Local Law amending the Code of the Town of Babylon, Chapter 213, Article I in reference to Zoning.

AMEND: §213-1.Definitions and word usage.

DECK - An open structure subordinate to the main building on a lot, used for purposes customarily incidental to the main building and associated with patios, porches, porticoes, balconies and sun decks, not used for habitation and which does not exceed the size of the main building. Decks having a height of 18 inches or less shall be considered accessory structures. Decks having a height of more than 18 inches, but five feet or less, shall be considered accessory buildings. Decks having a height of more than five feet shall be considered building extensions/ additions.

WHEREAS, Maal Holding Corp., (the "Petitioner") has heretofore petitioned this Board for a change of zone of certain property which is located on the s/e/c/o Wellwood Avenue & 9th Street, Lindenhurst, New York, SCTM #0100-129.00-03.00- 006.001, 002.000 & 084.000 from "B" Residence to "E" Business; and

WHEREAS, a public hearing was held on said petition on the 20th day of February, 2007; and

NOW, THEREFORE, be it

RESOLVED, by the Town Board of the Town of Babylon that Application #06-19AE for a change of zone from "B" Residence to "E" Business by Maal Holding Corp., (the "Petitioner") be and the same hereby is granted, and the Zone Map of the Town of Babylon be and the same hereby shall be amended to show the following described property in "Schedule A" attached hereto be changed from "B" Residence to "E" Business subject to the following conditions:

1. Subject to Zoning Board of Appeals granting any associated variances.

2. The developer must comply with the standard offsite requirements imposed by the Highway Division, Department of Public Works.

3. The entire building is to have a fully automatic fire sprinkler system installed pursuant to NFPA and Section 213-235 of the Town Zoning Code.

4. Fire and smoke detection system to be installed in accordance with NFPA 72. 5. Address number, building number or approved building identification to be placed in a position visible from the street.

6. Sewer district and water saving fixtures must be utilized.

7. Subject to SCDPW approval.

8. Owner/applicant shall comply with the Town of Babylon Stormwater Code (Chapter 189).

9. Owner/applicant shall comply with all NYS regulations for handicapped accessibility including but not limited to handicapped ramps and handicapped parking spaces.

10.Construction will be conducted between the hours of 7am and 8pm on weekdays and between the hours of 8am and 4pm on Saturdays. No construction will be permitted on Sundays. Construction activities on the site shall be in strict conformance with Chapter 156-9D if the Noise Code of the Town of Babylon.

11.Owner to contribute to the fund for the installation of emergency vehicle optical pre-emption equipment on traffic signals in the area. Estimated cost to be $1,500.00.

12.White pines along 1st Av. and the residential properties shall be replaced and/ or additional planted, if required, by Town of Babylon Engineering Division.

13.The buffer fence is to be as per Planning Board Specifications.

14.During construction, owner/applicant is responsible to sweep access streets and keep the roadways free of dirt and mud.

15.Details of the proposed site lighting are to be provided to the Commissioner of Planning and Development for approval and must conform to dark-sky lighting regulations.

RESOLVED, that the aforementioned change of zone shall not be effective until there has been filed with the County Clerk of Suffolk County the following Covenants and Restrictions to run with the land, subject to the approval of the Town Attorney:

1. No exterior-mounted steel security gates or shutters permitted. Only interior mounted mesh type security gates permitted.

2. All site lighting to be contained on site.

3. The owner/developer is responsible for maintaining all site development improvements including, but not limited to the following: fire and smoke detection system, automatic fire sprinkler system, building, drainage, curbs, sidewalks, fencing, asphalt, landscaping, etc.

4. No Basements shall be permitted.

5. As a minimum measure to reduce noise levels, applicant/ owner to install sound insulation panels around all roof top air-conditioning units, chillers and refrigeration units and sound insulation blankets around all air-handling units as per Town of Babylon Department of Planning & Development. All buildings, structures, signs, fences and landscaping shall be maintained in accordance with all applicable codes and ordinances of the Town of Babylon, and violations thereof may be prosecuted and enforced in the same manner as provided therein.

6. All noise generating equipment on-sight including but not limited to heating ventilation and air conditioning (HVAC), chillers, refrigeration units and compressors shall operate in conformance with Chapter 156 Town of Babylon Noise Code. In the event that any such equipment exceeds Chapter 156 standards immediate steps shall be taken to mitigate those noise levels.

7. All buildings, structures, signs, fences and landscaping shall be maintained in accordance with all applicable codes and ordinances of the Town of Babylon, and violations thereof may be prosecuted and enforced in the same manner as provided therein.

8. The attic is to be for utilities and storage only.

RESOLVED, that in case of any violation or attempted violation of any of the covenants by the owners or their lessees and failure of the owners to remedy any such violation within thirty (30) days after written notice by the restriction or condition 6. That the premises are to herein shall be cumulative and at the discretion of the Town Board as to how best to enforce such covenant, restriction or condition; the election of one method of enforcement shall not constitute a bar to electing any other method of enforcement permitted by law, and be it further,

A Local Law amending the Code of the Town of Babylon, Chapter 213, Article VIIA in reference to Zoning.

AMEND: § 2 1 3 - 75.9(A). Side yards.

A. In an AA Residence District, there shall be two side yards, one on each side of the building, except in the case of a corner lot where there shall be two front yards, one side yard and one rear yard which shall be opposite the principal front yard. The total of the widths of both side yards shall be not less than 50 feet, and no side yard shall be less than 25 feet wide; provided, however, that in the case of a lot held in single and separate ownership at the effective date of this amendment of this chapter, viz., July 25, 1954, and having a width of not less than 100 feet at the front street line, a single-family dwelling may be built thereon, provided that the width of the required side yards may be reduced to a total of 28 feet and the least side to not less than 10 feet minimum.

GENERAL INFORMATION AND REQUEST FOR PROPOSALS FOR AN ENERGY PROJECT

The Babylon Union Free School District is issuing this Request for Proposals (RFP) for the selection of an energy services company. You are invited to submit a proposal in accordance with this RFP.

Proposals must be received no later than THURSDAY, APRIL 26, 2007 @ 2:00 P.M. at the business office of the Babylon UFSD, located at 50 Railroad Avenue, Babylon, New York 11702.*

An original and five (5) copies of the proposal are required. To prevent opening by unauthorized individuals, your proposal should be identified on the envelope or other wrapper as follows:

RFP booklets may be examined and obtain at the Office of the Architect, John A. Grillo PC, located at 1213 Main Street, Port Jefferson, New York 11777, between the hours of 9:00 a.m. and 4:00 p.m. daily except Saturdays, Sundays and Holidays, on or after Thursday, March 15, 2007.

An RFP deposit of $25.00 is required in the form of a business check (no cash accepted) made payable to Babylon UFSD. This deposit shall be refunded only if the RFP booklet is returned in good condition within (30) calendar days after the submission date. All deposits shall be forfeited to the School District after the (30) days have elapsed.
